Terms & Conditions.

These terms govern your use of the Silent Rabbit iOS app and VPN service. Plain English where possible, lawyer language only where it has to be.

AT A GLANCE
  • You need an active App Store subscription to use the Service.
  • Cancel any time from Settings → Apple ID → Subscriptions.
  • Don’t use the Service for illegal activity. We can suspend accounts that do.
  • The Service protects the network layer — not the recipient’s device.
  • Ultra plans include a monthly bandwidth allowance — exceed it and we slow your server, we don’t cut you off.
  • Australian Consumer Law rights are not excluded by these Terms.
  • Disputes are governed by the laws of New South Wales, Australia.
SECTION 01

The agreement

These Terms & Conditions (“Terms”) form a contract between you and the operator of Silent Rabbit (“we”, “us”, “Silent Rabbit”), an Australian product studio. By downloading, installing or using the Silent Rabbit iOS app and associated VPN service (the “Service”), you agree to be bound by these Terms.

If you don’t agree, don’t use the Service. Uninstalling the app is the simplest way to end the agreement.

SECTION 02

Who can use the Service

You may use the Service if:

  • You are at least 13 years old. (If you are between 13 and 18, you confirm that a parent or guardian has reviewed and accepted these Terms on your behalf.)
  • Use of the Service is legal in your country of residence and the country you are physically in.
  • You are not on a sanctions list maintained by Australia, the United States, the United Kingdom, the European Union or the United Nations.
SECTION 03

Your account & the App Store

Silent Rabbit is distributed exclusively through the Apple App Store. Your subscription is created, managed and billed by Apple. You can cancel, change or refund your subscription via your iPhone (Settings → Apple ID → Subscriptions) at any time, subject to Apple’s policies.

You are responsible for keeping your Apple ID secure. We do not handle your password, payment card or full name — see our Privacy Policy for what we do see.

SECTION 04

Subscriptions, trials & refunds

The Service is offered on a subscription basis. Plans, prices and any free trial periods are displayed in the app at the time of purchase. By starting a free trial you authorise Apple to convert the trial into a paid subscription at the end of the trial period, unless you cancel beforehand.

Refund requests are handled by Apple under the App Store refund policy. We have no ability to issue App Store refunds directly. If you believe a charge is in error, contact billing@silentrabbit.net and we’ll help you raise it with Apple.

SECTION 05

Acceptable use

You agree not to use the Service to:

  • Break any law that applies to you, the recipient of your traffic, or our infrastructure.
  • Send spam, run denial-of-service or port-scanning attacks, or otherwise abuse third-party systems.
  • Distribute malware, conduct credential-stuffing, or operate command-and-control infrastructure for malicious software.
  • Infringe copyright, trade marks or other intellectual-property rights of third parties.
  • Generate, share or attempt to access child sexual abuse material (CSAM).
  • Resell, sublicense, or commercially redistribute access to the Service without our written consent.

We may suspend or terminate accounts that breach these rules. Where required by law, we will cooperate with Australian law-enforcement requests — limited by how little data we hold (see Privacy Policy).

SECTION 06

Fair use (Ultra)

Ultra subscriptions include a private, dedicated server with a generous monthly bandwidth allowance. The allowance depends on the region you choose for your server, is shown before you subscribe, and resets each billing month:

  • 500 GB — United States, Canada, Europe.
  • 200 GB — Singapore, Tokyo, Hong Kong.
  • 100 GB — Australia and other high-cost regions.

All traffic relayed through your server counts toward the allowance. We measure usage on the server itself; we do not inspect, log or record the contents or destinations of your traffic. If you exceed your allowance we slow your server (to about 1.2 Mbps — video calls keep working) rather than cutting you off. If usage passes twice your allowance in a month we may reduce speeds further or suspend the server until we’ve spoken with you.

Using your server as a public exit, proxy or reseller service, or for any sustained automated bulk transfer, is outside fair use and may lead to suspension. We’ll give you at least 30 days’ notice before reducing any allowance.

SECTION 07

What the Service does (and doesn’t)

Silent Rabbit is a VPN built for calls. While the tunnel is up, your traffic is carried over WireGuard to one of our exit nodes, so your network operator cannot see the contents or destinations of your calls. On iPhone and iPad you bring the tunnel up yourself — with one tap, or by leaving Always On enabled; on Mac the app can also connect automatically when a video call starts. The Service is designed to protect the network layer; it does not replace end-to-end encryption provided by the apps themselves and does not protect data once it leaves our exit nodes.

The Service does not anonymise you to the recipient of your call, does not bypass account-level identification by the calling platform, and does not guarantee uninterrupted availability on every cellular or Wi-Fi network you encounter.

SECTION 08

Availability & changes

We aim to keep the Service available 24/7 but make no uptime guarantee. We may add, remove or change features, exit regions, supported apps or pricing at any time. Material changes will be notified in the app or via the email address you have associated with your subscription (if any).

SECTION 09

Privacy

Our handling of your data is governed by our Privacy Policy, which forms part of these Terms. In short: we log your IP address and connection statistics, retain them for up to 30 days, and never log who you call, what you say or which apps you use.

SECTION 10

Intellectual property

The Silent Rabbit name, marks (including the rabbit head logo), the app interface, and all related materials are owned by us or our licensors. We grant you a limited, personal, non-transferable, non-exclusive licence to install and use the app on devices you own or control while your subscription is active. All other rights are reserved.

SECTION 11

Open-source components

The Service uses WireGuard and other open-source components. Their respective licences continue to apply to those components. A full list is available within the app under Settings → Open-source notices.

SECTION 12

Termination

You may stop using the Service at any time by cancelling your subscription in the App Store and uninstalling the app. We may suspend or terminate your access if you breach these Terms, if a payment fails, or if continued operation of your account would expose us to legal risk.

Sections 13 (Warranties), 14 (Liability), 15 (Indemnity) and 17 (Governing law) survive termination.

SECTION 13

Warranties & Australian Consumer Law

The Service is provided “as is”. To the maximum extent permitted by law, we make no warranties — express or implied — about the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) where doing so would be unlawful. Where the Service is supplied to you as a consumer, you have rights that cannot be excluded.

SECTION 14

Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with the Service is limited to the amounts you have paid us (via Apple) for the Service in the 12 months immediately preceding the claim.

We are not liable for indirect, consequential, special or punitive damages, lost profits, lost data, or damage caused by events outside our reasonable control (including outages of upstream providers, App Store policy changes, or network-level interference).

SECTION 15

Indemnity

You agree to indemnify us against any third-party claim arising from your use of the Service in breach of these Terms — including, but not limited to, claims that your activity infringed intellectual-property rights, breached the acceptable-use rules in Section 05, or violated applicable law.

SECTION 16

Changes to these Terms

We may update these Terms from time to time. We will revise the effective date above and, for material changes, notify you in the app. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

SECTION 17

Governing law & jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the federal courts of Australia for any dispute arising out of or in connection with these Terms.
