Read this first — we do not host anything
Silent Rabbit is a VPN. It carries traffic; it does not store, publish or host files, pages or media. There is no upload button, no shared storage and no public content of any kind. Everything that passes through our servers is in transit and is not retained.
That matters for what a copyright notice can achieve here. We cannot take down material we do not hold, and we cannot produce a copy of it. If your work is being hosted somewhere, the notice needs to go to whoever is hosting it.
What we can do is act on the account. If traffic that infringes your rights was carried by our network, tell us and we will investigate and, where it is warranted, suspend or terminate the subscriber responsible.
Sending us a notice
Send copyright notices to legal@silentrabbit.net. So we can act on it, please include:
- Your signature — electronic is fine — as the copyright owner or someone authorised to act for them.
- What work you say has been infringed. If there are several, a representative list is fine.
- Enough detail for us to identify the traffic: the IP address involved, and the date and time including the time zone. Without both we cannot match it to an account, and the notice cannot be actioned.
- How to reach you — address, telephone and email.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are authorised to act for the copyright owner.
An IP address and a timestamp are the two things we genuinely cannot work without. Our records are held for a limited period, so a notice sent promptly is far more likely to be actionable than one sent months later.
Designated agent
Notices under 17 U.S.C. §512 should be addressed to:
Designated Copyright Agent, Silent Rabbit
legal@silentrabbit.net
Silent Rabbit is operated from Australia. Sending a notice does not by itself create any obligation on us beyond those the law imposes, and we may decline to act on a notice that is incomplete or that we believe is being used for a purpose other than protecting a copyright.
If you think we got it wrong
If we suspend or terminate your account over a copyright notice and you believe that was a mistake or a misidentification, write to legal@silentrabbit.net with:
- Your signature.
- What was affected, and why you believe it was removed or disabled by mistake or misidentification.
- A statement under penalty of perjury that you believe that in good faith.
- Your name, address and telephone number, and your consent to the jurisdiction of a court where you live — or, if you are outside the United States, of any court where we may be found.
We will pass a counter-notice to the person who complained. If they do not tell us they have started court proceedings, we may restore your access.
Repeat infringers
We terminate the accounts of subscribers who repeatedly infringe copyright. This is not discretionary and it is not something a subscription buys an exemption from.
Because we do not host content, we count notices against the account rather than against any particular file. Accounts that attract repeated, substantiated notices are terminated, and no refund is given for the remainder of a term ended this way. A single unsubstantiated notice will not cost anyone their account.
Knowingly false notices
Under 17 U.S.C. §512(f), anyone who knowingly materially misrepresents that material or activity is infringing can be liable for damages, including costs and legal fees. That applies to counter-notices too. Please be sure before you send one.
Other complaints
For anything that is not a copyright matter — network abuse, security reports, privacy requests — use the address that fits: security@silentrabbit.net, privacy@silentrabbit.net, or support@silentrabbit.net. Sending a copyright notice to the wrong address will slow it down, not speed it up.
